StoryPenguin is an AI-powered storytelling platform that allows registered users to generate personalised, illustrated children's stories. Stories are created by adult users — such as parents, carers, and educators — for children to read and enjoy. The platform is a tool for adults; children are the intended audience of the content created, not users of the platform itself.
The Services are intended solely for users who are at least 18 years of age. By creating an account or using the Services, you confirm that you are at least 18 years old. Persons under the age of 18 are not permitted to register for or use the Services under any circumstances.
If we become aware that a user is under 18, we will immediately suspend or terminate that account and delete any associated data. If you believe a minor has registered for an account, please contact us at the address in Section 13.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are provided for unused time within a paid period unless required by applicable law.

The stories and illustrations produced by the Services are generated by artificial intelligence based on the prompts you provide. You acknowledge that:
Subject to your compliance with these Terms, you own the stories you generate through the Services and may use them for personal, non-commercial purposes. We retain a non-exclusive, royalty-free licence to use anonymised story data to improve the Services.

The StoryPenguin name, logo, website design, software, and all original content (excluding user-generated stories) are the intellectual property of StoryPenguin and its licensors. Nothing in these Terms grants you any rights to use our trademarks, trade names, or branding without our prior written consent.
The Services rely on third-party providers for authentication, payment processing, AI generation, and infrastructure. Your use of those third-party services is governed by their respective terms and privacy policies. We are not responsible for the acts or omissions of any third-party provider.
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.
To the fullest extent permitted by applicable law, StoryPenguin and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising under these Terms shall not exceed the amounts paid by you to us in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless StoryPenguin and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Services, your violation of these Terms, or your infringement of any third-party rights.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms.
